Terms of service.

The rules of the contract between you and Torpedo: what we provide, what it costs, what you may and may not send, and what happens when something goes wrong.

version 2026-10-12 · effective from 2026-10-12

This English text is a courtesy translation. The Portuguese version is the binding one and prevails in case of any difference.

1. Who provides the service

Torpedo is provided by {{COMPANY_NAME}}, registered at {{ADDRESS}}, Mozambique, NUEL {{NUEL}}, NUIT {{NUIT}}, licensed by INTIC under no. {{INTIC_LICENCE}}. Contact: hello@torpedo.co.mz · {{PHONE}}.

2. Acceptance, language and copy

By creating an account and ticking the acceptance box, you enter into a contract with us on these terms and the Privacy Policy. Before accepting you can review and correct the details you entered. You can view or print these terms at any time on this page.

These terms are written in Portuguese, which is the binding version. The English version is a courtesy translation.

If you are a consumer — a person using Torpedo for non-professional purposes — nothing in these terms limits your rights under the Consumer Protection Law (Law 22/2009).

3. The service

Torpedo provides APIs and a dashboard to send transactional email, SMS to Mozambican numbers and verification codes over WhatsApp, with delivery receipts, bounce suppression and webhooks.

We work to keep the service available and publish live status on the status page. Final delivery depends on carriers, email providers and Meta, which we do not control. Unless agreed in writing with service levels, we do not guarantee minimum availability.

4. Account, identification and API keys

  • You must be at least 18 and give truthful details. If you open the account for a company, you confirm you can bind it.
  • The law requires us to identify who uses the service (Law 3/2017, art. 19; Law 13/2026). We may ask for company documents, a NUIT or identification before enabling sending, sender IDs or higher volumes.
  • You are responsible for your API keys and everything sent with them. Keep them secret and revoke any key that may have been exposed in the dashboard.

5. Prices, payment and invoicing

  • Prices are published on the pricing page, in meticais (and in US dollars for card payments), and include applicable taxes unless expressly stated otherwise.
  • Email plans are paid per period; SMS and WhatsApp credits are prepaid and do not expire while the account is active.
  • Payments are processed by PaySuite (M-Pesa, e-Mola) or Lemon Squeezy (card). We issue invoices in Portuguese and in meticais.
  • If a plan payment fails, we tell you by email and may suspend the plan if it is not settled within 7 days.

6. Withdrawal and refunds

If you are a consumer, you may withdraw from the contract within 7 working days of purchase, without giving a reason, by emailing us. We refund what you paid, less what you have already used.

In any case, we refund unused credits when we close the account without just cause, or when you cancel because you do not accept a change to these terms or to prices.

7. Acceptable use

You may not use Torpedo to:

  • Send commercial messages without the recipient’s prior consent, or to bought, rented or scraped lists.
  • Phish, defraud, scam, spread malware, or impersonate another person, company or public body.
  • Ask recipients by message for card numbers, passwords, PINs or identity documents.
  • Send illegal or hateful content, child exploitation material, or content that infringes others’ rights.
  • Label promotional messages as transactional or verification messages, or use sender IDs that do not identify the real sender.
  • Get around limits, the suppression list, carrier controls or bot protection.
  • Do anything prohibited by the policies of AWS, Meta (WhatsApp Business) or the mobile carriers, which also apply to you.

8. Your obligations towards recipients

You are the controller of the data of the recipients you message. You represent and warrant that:

  • You have a legal basis for every message and, for commercial messages, the recipient’s prior consent (Law 3/2017, art. 40).
  • For promotional SMS, you respect per-category consent and the blocks required by INCM (Resolution 2/2026).
  • For WhatsApp, you have the recipient opt-in Meta requires.
  • Commercial messages identify the sender and include a free way to stop receiving them, and you honour those requests promptly.
  • You inform recipients about how their data is handled and deal with their complaints.
  • You give us proof of consent when we ask, or when a carrier or authority asks.

9. Moderation and suspension

We automatically block sends to addresses on the suppression list. We may limit or suspend sending, sender IDs or the account immediately when there are signs of a breach of these terms, abnormal bounce or complaint rates, risk to the network or third parties, or an order from a carrier or authority.

When we suspend, we tell you why unless the law prevents it. You can challenge the decision at hello@torpedo.co.mz, and we answer within 5 working days.

10. Data processing on your behalf

For recipient data, we act as your processor. We commit to:

  • Process the data only to provide the service and on your instructions, given through the API and dashboard.
  • Make sure everyone on our team with access is bound by confidentiality.
  • Apply the security measures described in the Privacy Policy.
  • Use only the sub-processors listed in the Privacy Policy, which these terms authorise, and tell you by email before adding or replacing one that handles message content, so you can object and cancel.
  • Help you answer recipients’ requests and meet your legal obligations.
  • Tell you without delay about any incident affecting your data.
  • Delete the data when the contract ends, except what the law requires us to keep.

11. Confidentiality and requests from authorities

We keep the content of your messages secret and only disclose it to third parties under a court decision or an order from a competent authority provided for by law, including data preservation orders (Law 14/2026). Where the law allows, we tell you before complying.

12. Intellectual property

Torpedo, its software, brand and documentation belong to us. The content you send is yours, and you give us only the permission needed to transmit and store it while we provide the service.

13. Liability

For ordinary negligence, our total liability to you is limited to what you paid us in the 12 months before the event. This limit does not apply to damage caused intentionally or through gross negligence, by us or by people working for us, nor to harm to life, body or health, and it does not override consumers’ mandatory rights.

If you are a business customer, we are not liable for lost profits or for indirect damage caused by failures of carriers, email providers or Meta outside our control.

14. Indemnity

If you are a business customer, you indemnify us against fines, carrier penalties and third-party claims arising from messages you sent in breach of these terms or the law.

15. Changes to terms and prices

We give at least 30 days’ notice by email of any change to these terms or to prices that works against you. If you disagree, you can cancel before the change takes effect at no cost, and we refund unused credits. Changes never apply to credits or periods already paid for.

16. Term and termination

The contract lasts until cancelled. You can close your account at any time, in the dashboard or by email. We may end the contract with 30 days’ notice, or immediately for a serious breach of these terms or under a legal order.

Before closing you can export your data through the API. Afterwards, we delete it within the periods in the Privacy Policy.

17. Complaints

Send complaints to hello@torpedo.co.mz. We record all of them, keep them for 5 years and answer within 15 working days. If you are not satisfied, you can go to INTIC, to INCM for SMS matters, to consumer protection bodies or to court.

18. Governing law and courts

These terms are governed by Mozambican law. Disputes are settled by the courts of Maputo City, without affecting consumers’ right to go to the court of their domicile. We do not impose arbitration on consumers.
